Terms
- A non-refundable deposit is to be paid upon completion of the Photography Agreement form.
- Agreements become valid following receipt of the deposit.
- Payment in full is due on the day of the session or event.
- Accepted forms of payment include: personal check, bank transfer or cash.
- Images will be provided via digital download 3-4 weeks following the session or event to the email address specified by The Client.
Copyright
- Files are given to The Client for printing additional photographs for personal use in albums or enlargements for personal use only and not for any commercial use.
- The copyright of the images still belong to Hanh Nguyen Photography even though the files are in the possession of The Client.
- The Client hereby gives Hanh Nguyen Photography permission to keep copies of digital photographs to use, publish, or advertise for promotional purposes in albums, publications, or on webpages.
- The Client waives any right to inspect or approve photos which may be used in promotions or publications.
Liability
- Hanh Nguyen Photography is in no way liable for injuries or damages that may occur in the execution of the contract in relation to equipment used or circumstances beyond the reasonable control of the photographer.
- While every possible precaution is taken and only reputable labs are used, Hanh Nguyen Photography assumes no liability for the loss or damage of images held in possession or while at labs or outside sources for services.
- While Hanh Nguyen Photography retains copies of the digital files, The Client
assumes responsibility for maintaining backups for long term archiving of the digital photographs from the original set provided to The Client.
Cancellation or Postponement
- Hanh Nguyen Photography must be notified immediately of any changes in schedule or location, at least one week prior to the scheduled date of session or event.
- In the event that The Client wishes to terminate the contract before completion, The Client forfeits the submitted deposit.
Final product
- Hanh Nguyen Photography is more than happy to edit out non-permanent marks and blemishes (i.e. pimples, zits, etc), but editing out things such as sockets, tattoos, make-up mishaps, and any additional photoshopping and editing will be at our discretion.
- We, the undersigned, fully agree to all terms and conditions stipulated in the contract, and that all personal information is current and correct. Should any times, dates and locations stipulated in this contract change, The Client is responsible to contact Hanh Nguyen Photography to correct and confirm these changes.
